Terms and Conditions
Quote Validity:
Quotes remain valid for 30 days unless otherwise stated. The Contractor may amend a quote before
acceptance if supplier pricing, freight, rebates or regulatory requirements materially change.
SiteInspection:
The quotation is based on information available at the time of quoting. A pre-installation inspection may
identify additional work or safety requirements. If such things occur, customers will be notified prior to
scheduling an installation date.
Existing Site Conditions:
The Contractor is not responsible for pre-existing roof defects, water leaks, structural issues, deteriorated
roofing materials, asbestos, or non-compliant electrical installations discovered during the works.
Safe Access:
The Customer must provide safe and unrestricted access to all work areas. Delays caused by restricted
access may result in additional charges.
Switchboard & Electrical Upgrades:
Where existing electrical equipment does not comply with applicable standards or distributor requirements,
upgrades may be required before installation can proceed. The costs for such upgrades will need to be paid
by customers. However, this will be disclosed and discussed prior to the contractor starting the job.
Delays:
The Contractor is not liable for delays caused by weather, network approvals, supplier shortages, industrial
action, government actions or other events beyond its reasonable control.
Variations:
Variations requested by the Customer or required due to unforeseen site conditions will be documented and
approved before the work proceeds where reasonably practicable.
Product Availability:
If specified equipment becomes unavailable, the Contractor may offer an equivalent or better product. The
Customer will be informed before substitution.
Practical Completion:
Practical Completion occurs when the system has been installed, tested and is safe to operate, even if grid
export approval or retailer meter reconfiguration remains outstanding.
Risk & Ownership:
Risk passes to the Customer on Practical Completion. Ownership remains with the Contractor until payment
has been received in full.
Payment Default:
If payment is overdue, the Contractor may suspend further work, withhold commissioning documentation
permitted by law, and recover reasonable debt recovery costs.
Suspension:
The Contractor may suspend works where safety concerns exist; required approvals have not been obtained,
or the Customer has failed to meet their contractual obligations.
Termination:
Either party may terminate the Agreement Prior to supply & installation of the quoted system. A written notice
must be given to another party to terminate the contract.
Warranties:
Warranty claims relating to equipment will be managed in accordance with the relevant manufacturer’s
warranty terms. Workmanship warranty claims should be reported as soon as practicable.
Performance Estimates:
Generation and savings estimates are indicative only and depend on weather, shading, customer
consumption patterns and network conditions
Australian Consumer Law:
Nothing in this Agreement excludes or limits any consumer guarantee or other right that cannot legally be
excluded under the Australian Consumer Law.
Privacy:
Personal information may be collected and used for quoting, installation, warranty administration, network
approvals, and legal compliance.
Dispute Resolution:
The parties agree to attempt to resolve disputes through good-faith discussions before commencing further
action, unless urgent relief is required. Please refer to section 3, clause 1 for complaints handling policy
Governing Law:
This Agreement is governed by the laws of the Australian State or Territory in which the installation takes
place.
